Joe Gibbs Racing has asked the Western District of North Carolina Court to compel Chris Gabehart, Chief Motorsports Officer at Spire Motorsports, and Spire Motorsports to produce documents about deleted text messages and to authorize subpoenas to cell carriers.
JGR alleges Gabehart admitted taking JGR trade secrets, deleting communications and accessing proprietary files after an November 6 conversation with team owner Joe Gibbs; the team is suing Gabehart for more than $8 million and is seeking expedited discovery before Judge Susan C. Rodriguez.
Chris Gabehart says JGR breached its contract by withholding payments, while Spire Motorsports denies seeking trade secrets and has produced nondisclosure agreements; filings show Gabehart disclosed deleting texts before November 15 and produced at least one message from Spire co-owner Jeff Dickerson, and the court ordered limited discovery into communications with Dickerson and Dan Towriss.
